This raffle is organised by BSTN Store GmbH, Kühler Weg 1, 82065 Baierbrunn (hereinafter referred to as “BSTN”).
The participation in the raffle is subject to the following conditions. A contract is concluded between the participant and BSTN with the following rights and obligations. With his/her participation and consent, the participant expressly acknowledges these conditions of participation. BSTN reserves the right to modify, adjust, cancel or interrupt the raffle at any time on reasonable grounds (with prior notice, where possible). BSTN reserves the right to exclude participants who violate the conditions of participation.
The raffle only takes place online on our website (www.bstn.com) and/or on our social media pages. We usually do not announce the start of the raffle in advance. The exact end (date and time) of the raffle will be communicated by us after it started. The time of release will be notified as well.
Natural persons who are at least 16 years of age at the time of participation are eligible to participate. It is not possible to participate several times. Employees of BSTN Store GmbH are not permitted to participate. Any automated participation or any participation via raffle associations is excluded.
BSTN reserves the right to check eligibility and to request a proof of age and identity (e.g. an ID card copy). Whoever fails to respond to this request may be excluded from participation. If this person has already been drawn as the winner, the price can be subsequently denied; any already delivered price can be claimed back.
Participants have to create a BSTN customer account or need to sign in with their existing account. Participants also need to follow one of our BSTN Instagram accounts with their Instagram profile. Once these requirements have been met, the logged-in participants can register for our raffles providing their size information and delivery address. Upon registration confirmation, the user then participates in the raffle. We select at random one or several winners among all participants.
The winner(s) is/are then entitled to purchase the article described on our website or social media page in the stated size subject to our General Terms and Conditions (plus any shipping costs). The winners will be announced at the end of the raffle by personal notification to the contact address stated by the participant (e.g. notification via the social media portal, e-mail or WhatsApp). The e-mail includes a link which is valid for 48 hours and via which the winner can purchase the product with the data stated for the participation in the raffle. The product can only be sent to the address stated for the participation, which cannot be changed subsequently. Only the payment methods stated in the checkout process are permitted.
If the winner does not redeem the winner link within 48 hours, the price will be cancelled without replacement. In this case, BSTN reserves the right (i) to either draw the price again at random among all participants, or (ii) to cancel the price without replacement and not find any new winner.
The price is not transferable, cannot be exchanged, and the counter-value cannot be paid out in cash.
Legal action may not be taken.
Should any provisions of these conditions of participation be or become invalid, this does not affect the legal validity of the remaining provisions. Any invalid provisions are replaced by a reasonable regulation that comes closest to the purpose of the invalid provisions.
BSTN Store GmbH is responsible for the data collection and processing.
The legal basis for the transmission of personal data for the participation in the raffle is point (b) of Article 6(1) GDPR. You can unsubscribe from the newsletter at any time (see below).
To prevent the unauthorised use of automated participations (e.g. via bots and other software or computer programs), we respectively store your used IP addresses and times of registration and confirmation. We can thus ensure a fair raffle to the benefit of all participants and counter any misuse. The legal basis for the processing of these personal data is point (f) of Article 6(1) GDPR.
Data are collected automatically for sending the newsletter, including, in addition to the e-mail address, the user data you provided to WhatsApp (which may include your user name), your mobile number, your device, all messages sent to our service and the messages you have read and clicked on. These data help us to send you individual messages according to your preferences.
Within the context of the newsletter, your use of the newsletter as well as the use of our website is evaluated as well. In order to record your usage behaviour on our website, cookies are used to recognise your browser. Your movements on our website can thus be traced, and the success of specific marketing measures can be recorded and measured. Moreover, our newsletters may contain hyperlinks (“links”) that include random, but distinct identification numbers. These identification numbers can be collected and stored when these links are accessed by your computer. We also use the information on such access to trace the use of the newsletter and our website and to measure the success of specific marketing measures. We can thus adjust our offers to your individual requirements and interests.
The participant can unsubscribe from the newsletter at any time via a special link at the end of the e-mail newsletter or by a relevant e-mail message to [email protected] The stated WhatsApp service can be cancelled as follows: If you do not wish to receive any more messages and wish to erase your data permanently, please send us a message stating “Remove all data” via WhatsApp. Please ensure exact spelling.
The legal basis for the processing of the participant’s personal data and for the dispatch of newsletters is point (b) of Article 6(1) GDPR.
Data subjects have the right to obtain information from the controller about their personal data and the right to the rectification of incorrect data or to erasure if any of the reasons stated in Article 17 GDPR applies, e.g. if the data are no longer required for the intended purposes. There is also the right to restriction of processing if one of the requirements set out in Article 18 GDPR is met and, in the cases of Article 20 GDPR, the right to data portability.
Any data subject has the right to lodge a complaint with a supervisory authority if he/she takes the view that the processing of data concerning him/her violates any data protection provisions. The right to lodge a complaint can be exercised, in particular, at a supervisory authority in the Member State of the data subject’s residence or at the place of the alleged violation. The competent supervisory authority for the federal state of Hamburg is the Hamburg Officer for Data Protection and Freedom of Information.
